Patexia Releases its Second ANDA Litigation Intelligence Report and Rankings
Patexia’s 2021 ANDA Litigation Intelligence Report is the second in an annual series that provides rankings, statistics and comprehensive analysis of ANDA and Hatch-Waxman stakeholders as part of its research division.
Santa Monica, CA (August 19, 2021): Today, Patexia, Inc., an IP company powered by Big Data and a global IP community, is proud to announce its second annual ANDA Litigation Intelligence Report as part of its Patexia Insight series.
ANDA and Hatch-Waxman litigation is one of the very important IP practice areas as it can significantly impact the profitability of brand or generic pharmaceutical companies. We realize that many law firms and attorneys active in this space, would like to distinguish themselves, so we evaluated 243 law firms and 1,471 attorneys including the law firms and attorneys that acted as local counsel. We assessed their data based on activity and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results.
We also understand that brand and generic pharmaceutical companies need to find the right counsel for their Hatch-Waxman cases. Our rankings can enable these companies to make better decisions based on proven records. Utilizing data from 1,179 ANDA cases filed over the past four years (July 1, 2017, through June 30, 2021), this comprehensive 111-page report ranks the law firms, local counsel, attorneys, judges, and companies by activity and performance.
Some interesting highlights from this year’s report include the following:
- During the last three years, 1,179 ANDA cases were filed by 215 brand pharmaceuticals against 194 generic pharmaceuticals.
- 1,208 unique patents were at the center of these ANDA cases
- 243 law firms represented the combined 364 pharmaceuticals either as defendants or plaintiffs.
- 1,189 ANDA attorneys acted as lead counsel for defendants or plaintiffs
- 289 attorneys acted as local counsel for plaintiffs and defendants of the 364 pharmaceutical companies:
- Teva Pharmaceuticals was the most active company with involvement in 134 cases
- Johnson & Johnson and Bristol Myers Squibb, both with a success rate of 100%, were the best performing companies in ANDA litigation.
- The report also analyzes patents involved in the cases as well as ANDA judges.
When asked about this year’s report and what is new, Pedram Sameni, the company’s CEO, relayed the following “This year for the first time, we have included the top three clients for each of the law firms and attorneys as well as the top 3 law firms, representing each of the pharmaceutical companies. Besides this, we have also included the list of ANDA-related lateral moves that we had detected since last year.” He further added: “This is useful to both law firms and corporations as it shows which firms are growing and most likely anticipate larger caseloads in the coming years .”
When discussing the rankings and future plans, Sameni commented “Patexia is the only company that performs this analytical review of all stakeholders in many areas of IP. In 2021, we are releasing a total of seven IP Insight Reports, covering key areas such as Patent Litigation in District Courts released in January, ITC Section 337 released in March, Patent Prosecution Intelligence and Trademark Prosecution released in June, this ANDA Intelligence Report, and also Inter-Partes Review and Federal Circuit patent related cases (CAFC) being released in September and October, respectively. In 2022, we plan to expand this further as we are evaluating ex-parte reexam as a newly popular area and may start covering it.”
