Patexia Releases its Third Annual Patent Litigation Intelligence Report and Rankings
Patexia’s 2023 Patent Litigation Intelligence Report, the third in an annual series, provides rankings, statistics, and comprehensive analysis of all stakeholders in U.S. District Court patent litigation as part of its Insight Division.
Santa Monica, CA (January 26, 2023): Today, Patexia Inc., an IP analytics company and global IP community, is proud to announce its third annual Patent Litigation Intelligence Report as part of its Patexia Insights series.
This report covers all patent cases, excluding ANDA/Hatch-Waxman, that were filed in one of the U.S. District Courts in a five-year period between July 1, 2017, and June 30, 2022. We have evaluated:
- 18,493 patent cases,
- 17,377 unique patents,
- 3,608 law firms,
- 17,052 attorneys and
- 20,065 entities
Patexia has ranked all stakeholders by Activity and Performance. We considered the number of patents in each case and the total number of cases an entity was involved in as a contributor to the Activity Score. The Performance Score was then calculated as the weighted average of the Activity Score and the Success Score.
Noticing the imbalance in patent case filings among states such as Delaware or Texas, we have dedicated a section to the Local Counsel to cover attorneys who primarily served as local counsel in patent cases. Additionally, we included a section analyzing the activity and performance of judges, including their judge score, or likelihood or frequency of ruling in favor of the plaintiff when a decision was made. For the 1,000 most active attorneys, we also identified the major lateral moves related to patent litigation that have occurred since the publication of last year’s report. Another update was the introduction of Patent Litigation Families, which groups all cases that involve one or more common patents, regardless of the venue in which they are being litigated, such as the PTAB, ITC, or CAFC. Additionally, our data, which includes all appeals from district courts to the Court of Appeals for the Federal Circuit, provides insights into appeal filings and their outcomes, as well as the rate of reversal, which ultimately impact the original district court decision.
