Patexia Releases its Third CAFC Intelligence Report and Rankings 

Patexia’s 2023 CAFC Intelligence Report marks the third installment in our annual series. This report delivers rankings, statistics, and a thorough analysis of CAFC stakeholders as an integral component of our dedicated research division. 

Santa Monica, CA (October 26, 2023): Today, Patexia, Inc., an IP analytics company and global IP community, proudly announces its third annual CAFC Intelligence Report as part of its Patexia Insights series. 

In the dynamic realm of intellectual property, the Court of Appeals for the Federal Circuit (CAFC) is a pivotal force, shaping the landscape of U.S. patent law as the ultimate appellate authority for patent disputes. The PTAB proceedings-originated appeals now constitute over 60% of the total appeals, a figure of increasing significance, particularly in the post-AIA era, following the introduction of Inter Partes Reviews in 2012. 

Our comprehensive assessment covered 2,991 companies, 1,080 law firms, and 5,452 attorneys, analyzing their activity and performance across various categories, including appellant, appellee, and overall standing. Given the challenges in the expanding CAFC landscape, where many law firms and attorneys find it difficult to stand out, we’ve empowered legal professionals and practice groups to showcase their expertise through independent third-party rankings and demonstrated achievements.

Furthermore, this extensive 120+ page report serves as a valuable resource for corporations seeking the right legal counsel for appeals. It enables organizations to make more informed decisions by leveraging our rankings, which are based on proven track records and our enhanced ranking methodology. Over the past five years, spanning from January 1, 2018, to December 31, 2022:

  • A total of 4,182 CAFC appeals were filed.
  • 1,080 law firms have represented appellants and appellees. From this number, 818 firms represented appellants, while 703 firms represented appellees.
  • 5,452 attorneys worked for these firms; 3,786 attorneys represented appellees, and 3,714 attorneys represented appellants.
  • For the period of our study, a total of 20 CAFC Judges were active.
  • Out of 2,991 companies as appellants and appellees, Apple is the most active company, with 263 appeals.

The report also encompasses a thorough analysis of annual trends in CAFC cases, their source courts, the appealing party, PTAB appeal rates, statistical insights into outcomes, and much more. We’ve continued the tradition of delivering a list of the most significant lateral moves that have occurred since the release of our previous CAFC report in 2022. This has been achieved by diligently tracking the moves of CAFC partners and associates between law firms.
