Patexia Releases 2024 PTAB Intelligence Report: A Comprehensive Analysis of Trends and Key Players in Patent Litigation

The 2024 PTAB Intelligence Report provides critical insights for IP professionals, companies, and legal practitioners navigating the ever-evolving patent litigation landscape.

With more than 6,806 PTAB proceedings analyzed, the report focuses on Inter Partes Reviews (IPR), Post Grant Reviews (PGR), and Derivation proceedings (DER), examining the fluctuations in filings, outcomes, and the performance of law firms, companies, and attorneys.

Notably, IPR filings peaked in 2020, with 1,443 filings, followed by a gradual decline. However, 2024 showed stability, with filings almost matching the mid-year numbers of 2023.
  • Year-over-Year Trends: A detailed analysis of the YoY filing trends highlights fluctuations in activity, offering a closer look at how companies are leveraging PTAB proceedings to challenge patent validity in response to district court litigation.
  • Top Stakeholders: The report ranks the most active law firms, companies, and attorneys involved in PTAB proceedings. These rankings provide an objective view of the top players in the field based on both activity and success metrics.
  • PTAB Outcomes: The report offers critical insights into how PTAB proceedings are resolved, revealing that approximately 32.3% of IPR proceedings result in denial of institution, while 32.4% lead to a final written decision, and 31.4% end in settlement.
