Patexia Releases First ITC Intelligence Report and Rankings
Patexia’s 2020 ITC Intelligence Report is the first in an annual series that provides rankings, statistics and comprehensive analysis of ITC Section 337 stakeholders as part of its research division.
Santa Monica, CA (January 2, 2020): Today, Patexia, Inc., an IP analytics company and a global platform for IP attorneys, is proud to announce its first ITC Intelligence Report as part of our Patexia Insights series.
We realize that many law firms and attorneys struggle to distinguish themselves in the important ITC Section 337 space, so we evaluated about 400 law firms and more than 7,000 attorneys on activity and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results.
We also know that the corporations sometimes struggle to find the right outside counsel. Our rankings can be leveraged by these organizations to make better decisions based on proven records. Utilizing data from 308 ITC Section 337 cases filed over the past six years (January 1, 2014 through December 1, 2019), this comprehensive report ranks about 400 active law firms, 1,000 attorneys and more than 1,600 companies..
Some interesting insights from this year’s report include the following (since January 1, 2014):
- A total of 308 ITC cases were filed.
- More than 11,000 professionals including 7,000 attorneys worked on these cases
- Adduci Mastriani & Schaumberg is the most active ITC firm with 84 cases
Of the more than 1,600 companies as complainants and respondents:
- Apple is the most active company with involvement in 19 cases
- Lowe’s is the best-performing company with a performance score of 83%
The report also analyzes patents involved in the cases as well as ITC judges.
When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following “ITC Section 337 is one of the important venues for patent litigation. While its volume is lower compared to PTAB or district courts, it is quite effective and at the same time, very quick and labor-intensive. This means companies need to invest a lot, once they get involved in ITC matters. Typical cost is between $4 million to $6 million dollars, which is invested over a short period of about a year. This means companies need to evaluate their counsel more carefully before hiring them as the outcome of their case, to a large extent, depends on their choice of counsel.”
Big data is becoming an integral part of the decision making process everywhere and this includes the legal sector. Nowadays, the cloud computing has enabled us to evaluate and analyze tens of thousands of documents in order to find out the best performing attorneys and law firms for different practice areas. This is a breakthrough as it enables companies to leverage these insights when it comes to choosing their next counsel, rather than relying on referrals through their networks. We believe this will grow even further in the coming years and it is the best way to increase the standard of service among law firms and legal service providers”.
He further added “this previously was not easy as the amount of data is massive and human review of all documents is almost impossible. For example, for this report, we had to design algorithms to review more than 75,000 ITC documents and this was only possible by using Big Data techniques and access to powerful computation power.”
When discussing the rankings and future plans, Sameni commented “There aren’t many independent third-parties focussed on data-driven rankings for ITC and other practice areas, and several of the law firms we spoke with, said this has given them the ability to do business development in a measured way which was not possible before”. He continued: “We released Inter-partes Review (IPR), and Patent Prosecution Intelligence Reports earlier in 2019, and are excited to announce our plan to add two new reports: patent litigation and patent transaction Intelligence Reports later in 2020”. Pedram Sameni is the CEO and founder of Patexia.
