Patexia Releases its Second CAFC Intelligence Report and Rankings
Patexia’s 2022 CAFC Intelligence Report is the second in an annual series providing rankings, statistics, and a comprehensive analysis of CAFC stakeholders as part of its research division.
Santa Monica, CA (October 27, 2022): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce its second annual CAFC Intelligence Report as part of its Patexia Insights series.
The Court of Appeals for the Federal Circuit (CAFC) is one of the most important venues for patent litigation. It has become crucial, especially post-AIA and the introduction of Inter Partes Reviews in 2012. Many law firms and attorneys struggle to distinguish themselves in the growing CAFC space, so we evaluated over 1,124 law firms and more than 5,558 attorneys on activity, success, and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results.
Additionally, this 100-page report helps corporations find the right counsel for appeal. These organizations can leverage our rankings to make better decisions based on proven records and our improved ranking methodology. This comprehensive report ranks the law firms, attorneys, and companies using data from over 4,363 patent-related CAFC appeals filed over the past five years (Jan., 1, 2017, through Dec., 31, 2021) according to their activity and performance.
- Some interesting highlights from this year’s report include the following:
- During the last five years, 4,363 CAFC appeals were filed.
- 1,124 law firms have represented appellants and appellees. From this number, 858 firms represented appellants, while 726 firms represented appellees.
- 5,558 attorneys worked for these firms; 3,858 attorneys represented appellees, and 3,785 attorneys represented appellants.
- For the period of our study, a total of 20 CAFC Judges were active.
- Out of 3,110 companies as appellants and appellees, Apple is the most active company, with 228 appeals.
The report also includes a comprehensive analysis of yearly trends of CAFC cases, their originating courts, and statistical information about the outcomes. For the first time, we included a section covering the most important lateral moves that happened since the publication of our first CAFC report in 2021 by tracking the movements of CAFC partners and associates between firms.
When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following: “Patent-related appeals originate from three different sources, the Patent Trial and Appeal Board (PTAB), International Trade Commission and District Courts. The task of gathering this data and putting it in one place is not easy. There are some organizations that offer some statistics related to CAFC, but they often prove incomplete and sometimes inaccurate”.
He added, “This year we have improved our attorney extraction methods by looking at multiple sources to verify the attorney’s presence in a case. We didn’t rely only on the PACER and CAFC website, but also checked the opinion documents and discovered a bigger number of attorneys, previously undetected”.
When discussing future plans, Sameni commented: “We now cover seven unique areas in IP every year including ITC Section 337, Hatch-Waxman Litigation, District Court Patent Litigation, Patent Prosecution, Trademark Prosecution, Inter-Partes Review, and Federal Circuit Court of Appeal (CAFC). We plan to continue expanding our reports and next year, we are looking at 8 to 9 areas including trademark litigation and possibly ex-parte reexams”.
