Patexia Releases Third Annual IPR Intelligence Report and Rankings

Patexia’s 2019  IPR Intelligence Report is the third in an annual series that provides rankings, statistics and comprehensive analysis of IPR stakeholders as part of its research division.

Santa Monica, CA (August 28, 2019): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce our third annual IPR Intelligence Report as part of our Patexia Insights series.  

We realize that many law firms and attorneys struggle to distinguish themselves in the rapidly growing IPR space, so we evaluated over 900 law firms and 5,000 attorneys on activity and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results. 

We also know that the corporations sometimes struggle to find the right outside counsel.  Our rankings can be leveraged by these organizations to make better decisions based on proven records.  Utilizing data from over 8,100 Inter-Partes Review (IPR) challenges filed over the past five years (July 1, 2014 through June 30, 2019), this comprehensive report ranks up to 500 most active law firms, attorneys and companies.

Some interesting insights from this year’s report include the following:t:

• During the last five years, 8,107 IPR cases were filed to challenge 5,005 unique patents. These petitions, challenged close to 83,000 unique patent claims.
• Claim-level data indicates that, on average, about 17 claims of each patent were challenged (83,233 claims of 5,005 patents)

Of the more than 3,000 companies as petitioners and patent owners:

• Apple is the most active company with involvement in 413 cases
• Pendrell Corporation is the best-performing company with a success rate of 100%

The report also analyzes challenges at the case, patent and claim levels to investigate denial and institution rates from many perspectives, including technology areas (bio-tech vs. high-tech), parties involved (petitioners vs. patent owners), and Patent Trial and Appeal Board (PTAB) judges.

When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following  “big data is becoming an integral part of the decision making process everywhere and this includes the legal sector. Nowadays, the cloud computing has enabled us to evaluate and analyze tens of thousands of documents in order to find out the best performing attorneys and law firms for different practice areas. This is a breakthrough as it enables companies to leverage these insights when it comes to choosing their next counsel, rather than relying on referrals through their networks. We believe this will grow even further in the coming years and it is the best way to increase the standard of service among law firms and legal service providers”.

He further added “this year, in response to our corporate and law firm clients, we have published the statistics of up to 500 most active attorneys, law firms and companies. While 500 represents approximately 10% of all attorneys active in IPR, we believe this covers a significant portion of all IPR cases. As a result, the majority of companies will be able to compare their counsel with the best performing firms and see where they stand ”.

When discussing the rankings and future plans, Sameni commented “There aren’t many independent third-parties focussed on data-driven rankings for IPR and other practice areas, and several of the law firms we spoke with, said this has given them the ability to do business development in a measured way which was not possible before”. He continued: “We released Patent Prosecution Intelligence Report earlier in 2019, and are excited to announce our plan to release ITC Intelligence Report later this year”.  Patexia is hoping to carve out a name as a trusted source in this area.

About Pedram Sameni
