Patexia Releases its Fifth  Annual IPR Intelligence Report and Rankings

Patexia’s 2021 IPR Intelligence Report is the fifth in an annual series that provides rankings, statistics and comprehensive analysis of IPR stakeholders as part of its research division.

Santa Monica, CA (September 9, 2021): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce its fifth annual IPR Intelligence Report as part of its Patexia Insights series.

We realize that many law firms and attorneys struggle to distinguish themselves in the growing IPR space, so we evaluated over 900 law firms and more than 5,000 attorneys on activity, success and performance, enabling lawyers and practice groups to market themselves based on independent third-party rankings and proven results.

Additionally, this 110-page report can help corporations find the right IPR counsel.  Our rankings can be leveraged by these organizations to make better decisions based on proven records.  Utilizing data from over 7,582 Inter-Partes Review (IPR) challenges filed over the past five years (July 1, 2016 through June 30, 2021), this comprehensive report ranks up to 1000 most active law firms, attorneys and companies.

Some interesting highlights from this year’s report include the following:

  • During the last five years, 7,582 IPR cases were filed to challenge 5,087 unique patents. These petitions challenged 80,831 unique patent claims.
  • Claim-level data indicates that, on average, about 16 claims of each patent were challenged
  • 930 law firms have represented patent owners and petitioners. From this number, 461 firms represented petitioners, while 768 firms represented patent owners.
  • 5,341 attorneys worked for these firms;  3,232 attorneys represented petitioners and 3,598 attorneys represented patent owners.
  • For the period of our study, PTAB has engaged a total of 195 Administrative Judges.

Of  2,658 companies as petitioners and patent owners:

  • Samsung is the most active company with involvement in 401 cases
  • Philips is the best-performing company with an overall performance score of 100%

The report also includes a comprehensive analysis of Denial and Invalidation by Technology Area and for the first time, the IPR lateral moves that took place since the publication of our previous report in September 2020.

When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following  “The IPR intelligence report was the first in our IP insight series and year after year, our valued clients have provided us with precious feedback which helped us improve this report along the way. We have improved data extraction and analysis which helped us discover new attorneys previously not detected. In addition, the 2021 edition, dedicates a section to lateral moves, first introduced in our ITC report back in March. ”.

He further added: “This year, in response to our community request, we have  included the top 3 clients for each of the law firms, and attorneys. We have also included the top 3 law firms, representing the first 1,000 most active companies”.

When discussing future plans, Sameni commented: “We expanded our offerings and now we cover seven unique areas in IP every year including ITC Section 337, Hatch-Waxman Litigation, District Court Patent Litigation, Patent Prosecution, Trademark Prosecution, Federal Circuit Court of Appeal (CAFC) and IPR”.
