Patexia Releases its Second Annual Patent Litigation Intelligence Report and Rankings

Patexia’s 2022 Patent Litigation Intelligence Report is the second in an annual series that provides rankings, statistics and comprehensive analysis of all stakeholders in US District Court Patent Litigation as part of its Insight Division.

Santa Monica, CA (February 3, 2022): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce its second annual Patent Litigation Intelligence Report as part of its Patexia Insights series.  

US District Courts are the main venues for patent litigation in the country. Up until last year, there was little or no effort to evaluate the performance of all stakeholders in patent litigation, analytically. Patexia changed this by introducing this annual report as part of its IP Insight Series.

This report covers all patent cases excluding ANDA/Hatch-Waxman that were filed in one of the US District Courts in a 4-year period between July 1, 2017, to June 30, 2021. The includes:

  • 14,506 patent cases,
  • 12,293 unique patents,
  • 3,050 law firms,
  • 14,685 attorneys and
  • 14,251 entities

Similar to our other Insight Reports, we ranked all the stakeholders by Activity and Performance. One major difference was that we also considered the number of patents in each case as a contributor to activity. The Activity Score was calculated as a weighted average of both the number of cases and the number of unique patents. Performance Score was then calculated as a weighted average of Activity Score and the Success Score.

We also included the Local Counsel category similar to last year and dedicated an entire section to those attorneys who mainly acted as local counsel in patent cases. This was important as some states such as Delaware or Texas have a large number of patent cases and some exclusively act as local counsel. Another update was the Lateral Moves section where we, for the first time this year, identified the major lateral moves related to patent litigation that took place since the publication of our first report. When asked about this second annual report, Pedram Sameni, CEO of Patexia relayed: “We are excited about this new release as the IP landscape is rapidly changing and our data immensely helps the IP community in their critical decision making. For example, our data shows how Texas law firms are losing their talents to Big Law firms with headquarters on the East Coast or West Coast as they enter cities such as Austin or Dallas”. He further added, “legal professionals are gradually using analytics and data for decision making and this prompts us to expand our offerings. This year we hope to add one or two new areas such as trade secret or copyright litigation to our collection”.
