Patexia Releases its Second ITC Intelligence Report and Rankings

Patexia’s 2021 ITC Intelligence Report is the second in an annual series that provides rankings, statistics and comprehensive analysis of ITC Section 337 as part of its research division.

Santa Monica, CA (March 18, 2021): Today, Patexia, Inc., an IP company powered by Big Data and a global IP community, is proud to announce its second annual ITC intelligence report as part of its Patexia Insight series.  

This popular report concentrates on the ITC Section 337 investigations. With the rise in patent litigation in 2020, corporations need better sources for evaluation and selection of their outside counsel. This second ITC Intelligence Report uses the historical data gathered from more than 300 ITC investigations filed between January 2015 and December 2020 to perform this evaluation.

This year, the report looks at 335 ITC investigations including 309 violation investigations to measure the activity and performance of all stakeholders. The report evaluates attorneys, law firms, companies (respondents and complainants) and Administrative Law Judges. 

Some interesting highlights from this year’s report include the following:

  • Since 2015, 335 ITC Section 337 investigations have been filed
  • 371 law firms have represented respondents or complainants in 309 violation investigations.
  • 5,650 ITC attorneys have represented more than 1700 respondents and complainants
  • More than 10,000 professionals including many testifying and non-testifying experts, translators, photographers, court recorders, etc. have directly or indirectly worked on these investigations
  • 1,784 companies were named either as complainants or respondents. 
  • 969 patents were at the center of these cases

​The report also analyzes patents involved in the cases as well as ITC judges. 

When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following  “ITC Section 337 is one of the important venues for patent litigation. The volume has been increasing recently and while it is lower than district courts, oftentimes many respondents are involved in a single case. He further added “This year, for the first time, we have also covered the most important lateral moves related to ITC since our previous report. This is useful to both law firms and corporations as it shows which firms are growing and most likely anticipate larger caseload in the coming years .”

When discussing the rankings and future plans, Sameni commented “Patexia is the only company that performs this analytical review of all stakeholders in many areas of IP. In 2021, we plan to release a total of seven IP Insight Reports. We released the District Court Patent Litigation Report in January and this ITC is our second report for the year. Next, we have Patent Prosecution, Federal Circuit Court of Appeal (CAFC), Hatch-Waxman (ANDA), IPR and Trademark which are all scheduled for release later in 2021”.
