Patexia Releases its Sixth Annual IPR Intelligence Report and Rankings

Patexia’s 2022 IPR Intelligence Report is the sixth in an annual series that provides rankings, statistics, and comprehensive analysis of IPR stakeholders as part of its research division.

Santa Monica, CA (September 8, 2022): Today, Patexia, Inc., an IP analytics company and global IP community, is proud to announce its sixth annual IPR Intelligence Report as part of its Patexia Insights series. 

We have evaluated 905 law firms and 5,626 attorneys based on activity, success, and performance, enabling attorneys and practice groups to market themselves based on independent third-party rankings and proven results. 

Additionally, this 110-page report can help corporations find the right IPR counsel. Different organizations can leverage our rankings to make better decisions based on data and proven records. Utilizing data from over 7,030 Inter-Partes Review (IPR) challenges filed over the past five years (July 1, 2017, through June 30, 2022), this comprehensive report ranks up to the 1,000 most active law firms, attorneys, and companies. With the latest improvements to our ranking methodology as well as evaluating the performance of all entities, we are now covering more ground.

Some interesting highlights from this year’s report include the following:

  • During the last five years, 7,030 IPR petitions were filed to challenge 4,966 unique patents. These petitions challenged 77,846 unique patent claims.
  • Claim-level data indicates that, on average, about 16 claims of each patent were challenged.
  • There have been 905 law firms that have represented patent owners and petitioners. From this number, 446 firms represented petitioners, while 771 firms represented patent owners.
  • There were 5,626 attorneys who worked for these firms;  3,403 attorneys represented petitioners, and 3,886 attorneys represented patent owners.
  • For the period of our study, PTAB has engaged a total of 187 Administrative Judges.

Of  2,471 companies as petitioners and patent owners:

  • Samsung is the most active company with involvement in 460 IPR matters
  • ACQIS Technology is the best-performing company with an overall performance score of 100%

In this report, we cover the IPR filing trends as well as take a closer inspection at the patent and claim level. Furthermore, we provide an analysis of the most popular IPC codes to discover which type of patents were being challenged the most. The report also includes a comprehensive analysis of Denial and Invalidation by Technology Areas and continues to provide the IPR lateral moves that took place since the publication of our previous report in September 2021.

When asked about this report and its importance, Pedram Sameni, the company’s CEO, relayed the following,  “The IPR intelligence report was the first in our IP insight series, and year after year, our valued clients have provided us with precious feedback which helped us improve this report along the way. For this year, we have improved our ranking methodology by taking into consideration the Adverse Judgments as well as giving more credit to the petitioner side when successfully invalidating claims in a patent. We have further improved data extraction and analysis which helped us discover new attorneys previously had gone undetected”.

When discussing future plans, Sameni commented: “We expanded our offerings and now we cover eight unique areas in IP every year including ITC Section 337, Hatch-Waxman Litigation, District Court Patent and trademark Litigation, Patent and trademark Prosecution, Federal Circuit Court of Appeal (CAFC) and  IPR. For next year, we are currently evaluating multiple topics, including ex-parte re-exam, Copyright, and trade secret litigation.”
