Patexia Releases its Third ANDA Litigation Intelligence Report and Rankings

Patexia’s 2022 ANDA Litigation Intelligence Report is the third in an annual series that provides rankings, statistics, and comprehensive analysis of ANDA and Hatch-Waxman stakeholders as part of its research division.

Santa Monica, CA (August 18, 2022): Today, Patexia, Inc., an IP company powered by Big Data and a global IP community, is proud to announce its third annual ANDA Litigation Intelligence Report as part of its Patexia Insight series. 

Hatch-Waxman litigation although comprising 10% of the total patent litigation, remains one of the most important IP practice areas as it significantly impacts the innovation coming from brand pharmaceutical companies as well as the profitability of the generic drug makers. In this report, we have evaluated 269 law firms and 1,857 ANDA attorneys. We have also provided a separate section for the attorneys who acted as local counsel. We performed our evaluation based on the activity and success of all stakeholders. This data-driven approach enables law firms and practice groups to market themselves based on independent third-party rankings and proven results.

Utilizing data from 1,439 ANDA cases filed over the past five years (July 1, 2017, through June 30, 2022), this comprehensive 115+ page report, ranks the law firms, local counsel, attorneys, judges, and companies in different categories.

Some interesting highlights from this year’s report include the following:

  • During the last three years, 1,439 ANDA cases were filed by 116 brand pharmaceuticals against 119 generic pharmaceuticals.
  • 1,531 unique patents were at the center of these ANDA cases
  • 269 law firms represented the combined 415 pharmaceuticals either as defendants or plaintiffs.
  • 1,540 ANDA attorneys acted as lead counsel for defendants or plaintiffs
  • 317 attorneys acted as local counsel for plaintiffs and defendants of the 415 pharmaceutical companies.
  • Teva Pharmaceuticals was the most active company with involvement in 160 cases
  • Vanda Pharmaceuticals with a success rate of 100%, was the best-performing company in ANDA litigation.

The report analyzes patents involved in the cases as well as ANDA judges. It also includes the list of ANDA-related lateral moves that Patexia had detected since last year as well as the list of the growing and declining firms based on this data.

Patexia’s goal is to directly help pharmaceutical companies as well as law firms using its vast data in life science patent prosecution and litigation. For this purpose, we have conducted a number of surveys to understand the needs and challenges pharmaceutical in-house counsel are facing. With a new and improved ranking methodology as well as being able to extract more information from various documents, we continue to provide the evaluation of all stakeholders in ANDA litigation based on activity and performance.
