Patexia Releases its Third ITC Intelligence Report and Rankings

Patexia’s 2022 ITC Intelligence Report is the third in an annual series that provides rankings, statistics and comprehensive analysis of ITC Section 337.

Santa Monica, CA (March 24, 2022): Today, Patexia, Inc., an IP company powered by Big Data and a global IP community, is proud to announce its third annual ITC intelligence report as part of its Patexia Insight  series.

This year, the report looks at 370 ITC investigations including 322 violation investigations filed between January 1, 2016 and December 31, 2021. It evaluates the activity and performance of all stakeholders. The report evaluates attorneys, law firms, companies (respondents and complainants) and Administrative Law Judges.

Some interesting highlights from this year’s report include the following:

  • Since 2016, 370 ITC Section 337 investigations have been filed
  • 367 law firms have represented respondents or complainants in 322 violation investigations.
  • 4,628 ITC attorneys have represented more than 2,000 respondents and complainants
  • More than 10,000 professionals including many testifying and non-testifying experts, translators, photographers, court recorders, etc. have directly or indirectly worked on these investigations
  • 2015 companies were named either as complainants or respondents.
  • 1050 patents were at the center of these cases

When discussing the rankings and this new release, Pedram Sameni, the company’s CEO, said: “ITC Section 337 has been growing in recent years. Our analysis of the market and law firms proves that many large firms are competing for ITC talents. The number of lateral moves in the past two years has been growing and in 2021 close to 100 ITC attorneys changed their firms”.  He further added “With this change in the landscape, and entrance of larger players, we expect to see more complaints filed in the coming years and that means the approximately $1B market will grow further soon”.

Aside from rankings of law firms, attorneys and companies, the report also covers the top clients for each of the attorneys and law firms. We have also included the major lateral moves and expansions of law firms for the second year in a row.

When discussing future plans, Sameni commented “Patexia is the only company that performs this analytical review of all stakeholders in many areas of IP, ITC Section 337 Investigations included. During 2022, we plan to release a total of eight IP Insight Reports. We released the District Court Patent Litigation Report in early February and this ITC is our second report for the year.
