These proceedings formed the basis of our extensive analysis, which includes statistics on all proceeding types, a detailed examination at both patent and claim levels, identification of active technologies by IPC codes, insight into denial rates, successful settlements, and final written decision outcomes. We also evaluate frequently challenged technologies, patent invalidation success rates, and assess Administrative Patent Judges’ activity and performance. Our meticulous ranking of PTAB stakeholders, including attorneys, law firms, and companies, based on their performance in IPR and PGR proceedings, rounds out this comprehensive report, providing invaluable insights into the world of patent challenges.

Key highlights from the PTAB Intelligence Report 2023: 

  • From July 1, 2018, through June 30, 2023, 6,849 IPRs, 282 PGRs, 48 CBMs, and 5 DERs were filed 
  • 6,849 IPRs targeted 4,898 distinct patents
  • 282 PGR proceedings targeted 254 unique patents
  • Extensive scope of the proceedings with 77,853 claims in IPRs and 4,604 claims in PGRs
  • 2,589 companies engaged in IPRs and PGRs (1,190 petitioners, 1,610 patent owners)
  • 992 law firms represented, with 491 for petitioners and 835 for patent owners
  • 6,014 attorneys were engaged, 3,636 attorneys advocating for petitioners, and 4,162 attorneys on the patent owner’s side
  • 180 administrative patent judges presided over an average of 33 cases each in PTAB proceedings 
  • Within the top 1000 most active attorneys, 31 lateral moves occurred, adding a dynamic element to the landscape
