New Trademark Intelligence Report 2024 and Rankings Shed Light on U.S. Trademark Landscape

This comprehensive study presents rankings, statistics, and insights into trademark prosecution, including the evaluation and ranking of applicants, law firms, and attorneys. 

Over the past five years, U.S. trademark applications have undergone fluctuations influenced by various events that have shaped the landscape, including the COVID-19 pandemic, initiatives by the USPTO, and the implementation of the Trademark Modernization Act. Our report aims to offer a comprehensive analysis of trademark activity and trends during this dynamic period. 

The report covers a five-year period from January 1, 2019, to December 31, 2023, analyzing 2,964,312 trademark applications submitted by 213,639 U.S. and foreign applicants, represented by 24,921 firms, and 32,484 attorneys. We explore filing and registration data, examining annual trends, renewals, abandonments, cancellations, office actions, and pendency. Our analysis encompasses both domestic and foreign activities, identifying the growth and decline of countries to pinpoint trends and changes in the data. Additionally, unique datasets featured in this report offer insights into trademark revenues, spending, top lateral moves, and the growth and decline of top firms/companies based on the number of trademarks filed in 2023 compared to 2022. 

Highlights of the report include:

Key Findings from the 2024 Patent Intelligence Report:

  • A total of 2,304,480 patent applications were processed between January 1, 2019, and December 31, 2023
  • Among these applications, 1,882,495 patents were granted
  • The issued patents collectively comprised 28,303,343 claims 
  • 140,355 entities were actively engaged in the patent landscape
  • 3,277 firms served as representatives for these entities
  • 28,843 patent attorneys and agents were actively involved in patent prosecution 

In addition, we have provided a comprehensive Excel file containing rankings and scores, as well as all useful metrics about the top 2,000 attorneys, companies, and law firms, including:

  • The estimated 5-year patent revenue generated by attorneys/agents and patent firms
  • The estimated 5-year spending on US patent prosecution by corporations including the law firm fees, the USPTO fees, and the US patent portfolio maintenance
  • The top three clients for each of the attorneys/agents and law firms as well as the volume of work handled for each

This comprehensive report provides valuable insights and analysis into the trends and developments within the U.S. International Trade Commission’s (ITC) Section 337 investigations, including rankings of all stakeholders. 

Santa Monica, CA (February 26, 2024): Today, Patexia, Inc., a leading provider of intellectual property analytics and insights, is pleased to announce the release of its highly anticipated ITC Intelligence Report 2024 as part of its Patexia Insights series. 

Section 337 Investigations by the International Trade Commission (ITC) have gained popularity in recent decades due to globalization, resulting in increased imports and IP-related risks. In 2023, there was a decrease in the number of investigations initiated, contrasting with the yearly growth observed in preceding years. Despite this recent decline, law firms have strategically positioned themselves by establishing and growing their ITC practice through hiring, while also utilizing the ITC as a strategic avenue to increase their chances of success. 

The ITC Intelligence Report 2024 offers an in-depth analysis of the 396 investigations initiated under ITC Section 337 from January 1, 2018, to December 31, 2023. Drawing from extensive data and rigorous analysis, the report examines various aspects of these investigations, including the number of filings, case outcomes, parties involved, and trends over time. 

In this report, we have thoroughly evaluated and ranked 372 law firms, 4,656 attorneys, 1,874 companies, and 10 Administrative Law Judges (ALJs). This analysis serves as a valuable resource for firms and attorneys operating in a highly competitive market where it is challenging to stand out. By providing insights into the performance and activity levels of stakeholders involved in ITC investigations, our report equips companies, firms, and attorneys with the information they need to enhance their strategies, improve their performance, and differentiate themselves in the marketplace.

Over the six-year period from January 1, 2018, to December 31, 2023:

  • A total of 396 investigations were initiated, with 299 categorized as violations 
  • More than 10,000 professionals, including testifying and non-testifying experts, translators, photographers, court recorders, and other specialists, have been directly or indirectly involved in these investigations
  • 372 law firms were active, with 173 representing complainants and 309 representing respondents 
  • 4,656 attorneys were engaged in these investigations, with 2,408 representing complainants and 3,408 representing respondents 
  • 1,874 companies were involved, with 266 acting as complainants and 1,660 as respondents
  • 973 patents were at the center of these cases

The report provides an analysis of key statistics, examining filing trends, investigation outcomes, appealed decisions, unfair acts, and the most prevalent IPC codes for patent infringement, among other metrics. Attention is paid to the duration of investigations, with data depicting the average termination times by year, as well as its variations depending on the investigation outcome. Additionally, the lateral moves among the top 1,000 attorneys are covered, highlighting key transitions and the growth or decline of law firms in terms of the number of attorneys who joined and left.

This report encompasses all patent litigation cases, excluding ANDA/Hatch-Waxman filings, filed within the U.S. District Courts over a five-year span from July 1, 2018, to June 30, 2023. Our assessment includes:

This comprehensive report delves into detailed statistics, capturing annual and monthly filing trends, highlighting monthly filing averages, and providing insights into the number of patents involved in these cases. It also examines the most popular district courts and states for patent litigation, as well as sheds light on the status of terminated cases, conducting a thorough analysis of judgment conclusions. Additionally, the report explores the duration of cases and identifies the most litigated technologies based on IPC codes, offering a comprehensive overview of the patent litigation landscape. 

Moreover, the report extends its evaluation to all stakeholders involved in patent litigation, encompassing attorneys, law firms, companies, and judges. It employs a further improved methodology to rank these entities by Activity and Performance, considering their roles as plaintiffs, defendants, and overall. Recognizing the significance of states with high activity levels, such as Texas and Delaware, the report identifies attorneys serving as local counsel, dedicating a separate section to their contributions. Additionally, we conducted a comparison of this year’s attorney data with that of the previous year, identifying lateral moves of attorneys who transitioned between firms or established their own firms. This analysis led to the inclusion of the full list of law firms that experienced growth or contraction in terms of patent litigation attorneys.

Furthermore, a separate analysis has been included, drawing attention to the notable activity surrounding the Honorable Judge Alan Albright. This analysis is particularly needed due to a recent order that patent litigation cases in the Western District of Texas will be randomly assigned to judges, underscoring the potential impact on the landscape of patent litigation within the jurisdiction.
